Planning conditions
On receiving planning permission the decision notice will often include conditions requiring the submission of details. These conditions tend to fall into two categories:
- Conditions that must have the details approved before any work on the site commences. These are known as conditions precedent and generally begin with the words "no development shall commence until..."
- Those that require details to be submitted, approved and implemented prior to the development being brought into use. For example "the building shall not be occupied until..."
How to agree a planning condition
To agree a planning condition, you need to complete a "submission of details to agree a planning condition form" (form 27). This is available on our planning application forms page.
We aim to respond to most requests within four weeks, but it could take eight weeks or longer to respond to your submission. So please make sure you send in the details well in advance of the time you wish to commence work on site.
Please provide as much detail as possible when submitting your form. If in doubt please contact the case officer before submitting it.

We will check everything is correct and contact you if it is not. We will then register the application and write to you giving you the details of the case officer and a proposed time period for our response.
Should we fail to give a decision within eight weeks of us registering the application you have the right to appeal to the Planning Inspectorate unless you have agreed an extension to this process. Similarly, if you disagree with our decision you also have the right of appeal to the Planning Inspectorate. If within a period of 12 weeks after registering your request we have not responded to it, you are entitled to a full refund of your fee.
Where necessary we will contact you during the course of the application to request additional information. However, if that information is not forthcoming within one week of the request we will determine the application on the information at hand.
Charges
The fee is £25 where a request relates to a permission for development that falls within these categories:
- Enlargement, improvement or other alteration to an existing dwelling house
- Carrying out of operations within the curtilage of an existing dwelling house. for purposes ancillary to the enjoyment of the dwelling house
- Erection or construction of gates fences walls or other means of enclosure along a boundary of the curtilage of an existing dwelling house
For all other conditions attached to the grant of planning permission the fee is £85 per request.
There is no fee for approval of conditions under the advertisement regulations or under the Planning (Listed Buildings and Conservation Areas) Act 1990.
